These Terms and Conditions (“Terms”) govern your use of the EPW website and your booking, purchase or participation in any course, programme, workshop or related service offered by EPW (“Course”). Please read them carefully before making a booking.
By using this website, submitting a booking request, paying an invoice or attending a Course, you confirm that you have read and accepted these Terms. If you book on behalf of an organisation or another participant, you confirm that you are authorised to accept these Terms for them and that you will make the relevant terms available to each participant.
Nothing in these Terms limits any rights or remedies that cannot legally be limited, including mandatory consumer rights that may apply in your country.
1. About these Terms
In these Terms, “EPW”, “we”, “us” and “our” refer to the provider identified on the relevant quotation, invoice or booking confirmation. “Customer” and “you” refer to the person or organisation making the booking. “Participant” means each person registered to attend a Course.
These Terms apply together with the Course description, quotation, invoice and written booking confirmation. If there is a conflict, any special terms expressly agreed by EPW in writing will take priority for that booking.
2. Course information and availability
We aim to keep Course descriptions, dates, venues, trainers, fees and availability accurate. Course information is provided in good faith but may change before a booking is confirmed. Images and descriptions are illustrative and do not form a guarantee that every Course will be delivered in exactly the same way.
All Courses are subject to availability. Submitting an enquiry, registration form or purchase request does not by itself create a confirmed booking or require EPW to accept it.
3. Booking and contract formation
A booking is accepted only when EPW sends written confirmation, issues an invoice, or otherwise confirms acceptance in writing. We may request further information or payment before confirming a place.
You are responsible for ensuring that all registration details are complete and accurate, including participant names, contact information, billing details, accessibility needs and any relevant prerequisites. Please notify us promptly if any information changes.
Unless EPW agrees otherwise in writing, a place is not guaranteed until the required payment has been received and cleared.
4. Fees, invoices and payment
Course fees are those shown in the applicable quotation, invoice or booking confirmation. Any applicable taxes will be stated separately where required.
Full payment must be made by the due date shown on the invoice and, in all cases, before the Course begins unless EPW has agreed different payment terms in writing. The Customer is responsible for bank charges, currency-conversion costs and other payment-provider fees.
EPW may suspend access, withhold Course materials or certificates, or cancel an unpaid booking if payment is overdue. This does not remove the Customer’s obligation to pay amounts already due.
If a payment is reversed, disputed or charged back without a valid basis, the outstanding amount remains payable together with any reasonable costs incurred in resolving the matter, to the extent permitted by law.
5. What the Course fee includes
Unless the Course description or quotation states otherwise, the fee includes tuition, standard Course materials and a certificate for Participants who satisfy the applicable requirements. Refreshments are included only where expressly specified.
Travel, accommodation, meals, visa fees, insurance, personal expenses, equipment and any other costs are not included unless EPW confirms otherwise in writing.
6. Course schedule and delivery
Unless stated otherwise, a standard Course is delivered for approximately three hours per day over five days. Actual schedules, breaks, delivery methods and learning activities may vary according to the subject, trainer, venue, time zone and Participant needs.
Courses may be delivered in person, online, in a hybrid format or at a Customer’s premises, as stated in the booking confirmation. Participants are responsible for having suitable equipment, software and internet access for online delivery.
7. Customer cancellations and refunds
Cancellation requests must be sent to EPW in writing. The effective cancellation date is the date on which EPW receives the written request.
- If EPW receives the request at least 14 calendar days before the Course start date, the Customer is entitled to a full refund of the Course fee paid.
- If EPW receives the request fewer than 14 calendar days before the Course start date, the Course fee is non-refundable and any unpaid balance remains due.
- Non-attendance, late arrival, early departure or failure to complete a Course does not entitle the Customer or Participant to a refund.
Approved refunds will normally be made to the original payment method within a reasonable period. These cancellation rules do not override any mandatory cancellation or refund rights that apply by law.
8. Participant substitutions
The Customer may request that another suitable person attend in place of the registered Participant by giving EPW at least three calendar days’ written notice before the Course starts. Substitutions are subject to any Course prerequisites, security requirements and reasonable administrative checks. EPW may refuse a proposed substitute who does not meet the applicable requirements.
9. Transfers to another Course
A request to transfer a booking to a different date or Course must be made in writing at least 10 calendar days before the original Course start date. Transfers are subject to availability and EPW’s written approval. Any difference in Course fees must be paid before the replacement Course begins.
A transfer request made later than this may be treated as a cancellation. If a transferred booking is later cancelled, EPW may apply the cancellation period by reference to the original Course start date, to the extent permitted by law.
10. Changes or cancellation by EPW
EPW may make reasonable changes to the trainer, venue, timetable, Course content or delivery format where necessary to deliver the Course safely and effectively. We will try to provide reasonable notice of material changes.
EPW may postpone or cancel a Course because of insufficient enrolment, trainer unavailability, venue problems, safety concerns, events beyond our reasonable control or other operational reasons. Where possible, we will offer a suitable alternative date, venue or delivery format.
If EPW cancels a Course and the Customer does not accept the alternative offered, EPW will refund the Course fee paid for the affected Course. To the maximum extent permitted by law, EPW is not responsible for travel, accommodation, visa, loss of earnings or other indirect costs arising from a Course change or cancellation. Customers should make flexible arrangements and obtain suitable insurance.
11. Attendance, assessment and certificates
Participants must attend the level of the Course required in the Course description. If no specific level is stated, attendance of at least 75% is required to qualify for a certificate.
A certificate may also depend on completing assessments, exercises or other Course requirements and on full payment having been received. EPW may record a Participant’s name on the certificate exactly as supplied during registration.
A certificate confirms participation or completion only; it does not guarantee employment, promotion, professional licensing, accreditation or any particular result.
12. Participant responsibilities and conduct
Participants must behave professionally, comply with reasonable trainer and venue instructions, respect other Participants and follow applicable health, safety, security and technology policies. Harassment, discrimination, intimidation, disruption, unlawful conduct, unauthorised recording or misuse of Course systems is not permitted.
EPW may remove a Participant whose conduct is unsafe, unlawful or materially disruptive. No refund will be due where removal results from the Participant’s breach of these Terms, subject to applicable law.
Participants should tell EPW as early as possible about reasonable accessibility requirements. We will make reasonable efforts to accommodate notified needs but cannot guarantee that every adjustment will be available in every location or format.
13. Travel, accommodation and visas
The Customer and Participant are responsible for passports, visas, travel permissions, insurance, transport and accommodation. Any invitation or confirmation letter issued by EPW is for administrative support only and does not guarantee that a visa or entry permission will be granted.
A visa refusal or travel disruption does not automatically entitle the Customer to a refund. The cancellation and transfer rules above will apply unless mandatory law requires otherwise.
14. Course materials and intellectual property
All Course materials, presentations, exercises, recordings, graphics, trademarks and other content supplied by or on behalf of EPW are protected by intellectual-property laws. Unless EPW agrees otherwise in writing, the Customer and Participant receive a personal, non-exclusive, non-transferable licence to use the materials for their own learning and internal reference.
You must not copy, publish, sell, licence, distribute, translate, modify, upload, broadcast, record or commercially exploit Course content without prior written permission. You must not share login details or provide unauthorised access to paid materials.
Participants retain ownership of material they submit, but grant EPW a limited licence to use it only as necessary to administer, assess and deliver the Course.
15. Website use
You may use the EPW website only for lawful purposes. You must not attempt to gain unauthorised access, introduce malicious software, interfere with site operation, misuse forms or payment systems, impersonate another person, scrape content at scale, or use the website in a way that infringes another person’s rights.
EPW may restrict or suspend access where reasonably necessary to protect the website, its users or its systems. We do not guarantee that the website will always be uninterrupted, secure or free from errors, although we take reasonable steps to maintain it.
16. Privacy and third-party services
EPW handles personal information in accordance with its Privacy Policy. By providing information to us, you confirm that you are authorised to do so and that the information is accurate.
The website or Course materials may link to third-party websites, platforms or services. EPW does not control them and is not responsible for their content, availability, security or privacy practices. Your use of a third-party service may be governed by separate terms.
17. Educational disclaimer
Courses and website content are provided for education and general information. They are not a substitute for legal, financial, medical, regulatory or other professional advice. Learning outcomes depend on factors including attendance, preparation, participation and prior experience, and EPW does not guarantee a specific personal, academic or commercial result.
18. Liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.
Subject to the paragraph above and to the maximum extent permitted by law, EPW is not liable for indirect, incidental, special or consequential loss; loss of profit, revenue, business, opportunity, goodwill or anticipated savings; or costs arising from travel, accommodation or third-party arrangements.
Subject to applicable law, EPW’s total liability arising from or connected with a Course will not exceed the Course fee actually paid to EPW for the affected Participant and Course. The Customer is responsible for keeping appropriate backups of any data or materials used during training.
19. Events beyond reasonable control
EPW is not responsible for delay or failure caused by events beyond its reasonable control, including severe weather, natural disaster, epidemic, pandemic, war, civil disorder, industrial action, transport disruption, government action, utility failure, venue closure, telecommunications or internet failure, or illness and unavailability that could not reasonably be avoided.
EPW will take reasonable steps to reduce disruption and may reschedule, relocate or change the delivery format of the affected Course.
20. Concerns and complaints
If a concern relates to the trainer, venue, content or delivery of a Course, please raise it with the trainer or EPW as soon as possible, ideally on the first training day, so that we have an opportunity to address it.
Formal complaints should be sent to support@epw.com with the booking details and a clear description of the issue. We will review the complaint and respond within a reasonable time.
21. Changes to these Terms
EPW may update these Terms from time to time. The version published when a booking is accepted will normally apply to that booking, unless a change is required by law or is agreed with the Customer. The “Last updated” date at the top shows when this page was most recently revised.
22. General provisions
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect. A delay or failure by EPW to enforce a right does not waive that right. The Customer may not transfer its rights or obligations without EPW’s written consent, except for a Participant substitution permitted above.
These Terms, together with the applicable quotation, invoice, booking confirmation and any expressly incorporated policy, form the entire agreement concerning the Course and replace earlier discussions or representations about the same subject.
23. Governing law and jurisdiction
These Terms and any dispute or claim arising from them are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, subject to any mandatory rights that allow a consumer to bring a claim in another competent court.
